Fantasy Sports Legality in Question: Gaming or Gambling?

Several politicians want to revise fantasy sports legality because they believe this type of gaming should be treated the same way as online sports betting.

The future of fantasy sports legality is doubtful again as A. G. Burnett, Gaming Commissioner in the State of Nevada, aims to change US gambling laws. Mr Burnett announced that fantasy sports legality needs to be revised more carefully. His words might mean that the ever-lasting fantasy sports controversy might reach an end whether it should be regarded as gaming or gambling.

He is not alone with his opinion in the political scene. Republican Congressman Frank Pallone also believes that fantasy sports legality needs to be improved and its connection to sports betting should be examined thoroughly. Pallone also complained that fantasy sports scams are more than probable to happen as is seems like “murky business.”

Gambling laws are protecting fantasy sports services – for now!


Thanks to the 2006 Unlawful Internet Gambling Enforcement Act, fantasy sports providers like DraftKings and FanDuel can feel secure. This law clearly states that there is a huge difference between fantasy sports and sports betting. However, when it was introduced, fantasy sports gambling was not even close to what it is today – it used to be a hardly-commercialized game, which turned into a billion dollar business.

Online casinos in the US also complain about fantasy sports legality, or probably even more because of their own illegality. They believe that fantasy sports providers are being treated with double standards because they offer the same type of gaming, yet one is legal while the other is banned. Maybe one day both fantasy sports and sports betting providers will be measured with the same standards, and both will be made legal… or banned!
