There are no specific Indian poker laws on the Public Gambling Act from 1867. And because the act states that it is illegal to run or to be present in any gaming house, it could be argued that poker would fall under this rule. However, for the most part, the game is considered to be one of skill in the country.  This conception comes from two facts, mainly. The Supreme Court has declared Rummy - very popular in the Indian variation of the game - to be more of skill than chance, despite the luck factor being present. That is, the skill of the participant has more impact on the outcome. The second fact contributing to this was a raid on a poker club. During the trial, both players and operators were cleared from the charges, as the Madras High Court considered poker a game of skill, allowing the club to conduct the game.   Still, each state has the power to decide whether poker is legal or not. This is why there are only a few places where it is possible to play the game. For example, the Gujarat High Court has ruled that poker is a game of chance.  But other states follow the general assumption that it is a game of skill. Under the Nagaland Prohibition of Gambling and Promotion and Regulation of Online Games of Skill Act from 2015, licenses can be issued for offering poker, as well as under the Sikkim Online Gaming (Regulation) Rules from 2009.
