Netherlands Lottery Law Review

Everything begins with the Wet op de kansspelen, a law from 1964 that still works as it did during its creation. However, it still does the heavy lifting for the modern era. The Remote Gaming Act makes it so that without a license, nobody may give people the opportunity to compete for prizes where chance decides the winner, and nobody may promote participation in such a game. The law is aimed at the operators, and not the participants. The state lottery has its own license, and only one of such exists. When the KSA brought it in line with the other monopoly licenses in 2022, it noted that the Staatsloterij (State Lottery) license has no end date, which is why it was treated as an amendment rather than a new license. Then came the Koa amendment, which made online casinos and betting legal. It was the opening for a licensing system for the knasspelen opf afstad. But it did not turn lotteries into online games. Buying a Staatslot on an app is still a lottery purchase.

State Lottery: Staatsloterij

The state lottery has its own licence, and only one can exist. When the Ksa brought it in line with the other monopoly licences in 2022, it noted that the Staatsloterij licence has no end date, which is why it was treated as an amendment rather than a new licence.

The Lotto B.V. games

The Wok allows just one legal entity to hold the licence for each of the land-based games: the instant lottery (scratch cards), sports betting and lotto. And there's a quirk hidden in the text: Article 27b says the lotto licence can only be granted to the same entity that already holds the sports betting licence under Article 16. Lotto and TOTO are legally joined at the hip. Eurojackpot and Lucky Day run under the Lotto licence too.

Can Players Be Penalized For Using Unlicensed Lottery Sites?

The law is built to punish organisers, and there is no evidence that Dutch player prosecution has ever happened for buying an offshore lottery ticket. The Wok’s article 1 speaks about offering and promoting. But I wouldn’t tell you it’s zero-risk either. The Kansspelautoriteit’s own FAQ on illegal online lotteries states that joining an online lottery is only allowed when the organiser holds a license, and that otherwise participation is punishable, including through Instagram or Facebook. That page is about “diploterijen”, which is the social media raffle and prizes category. The KSA lists the player-side risks plainly: You may pay for a prize that doesn’t exist, and there is no payout guarantee. No protection if you are scammed, and the government will not chase your lost cash.

The Regulator: Kansspelautoriteit

The KSA has supervised Dutch gambling since 2012. For lottery players, it does three useful things: it licenses the operators, it runs the Kansspelwijzer (a lookup tool where you can check whether a lottery is legal), and it takes enforcement action against illegal offers. Its toolkit against illegal lotteries includes ordering organisers to stop and imposing fines. A lottery messenger buys a real ticket for you in another country (say, a EuroMillions ticket in Spain) and holds it on your behalf. Lottery betting sites don't buy tickets at all; they take a bet on the outcome of a draw and pay you from their own pocket or an insurance policy. The Openbaar Ministerie prosecuted four men from Afferden and Nijmegen who ran an illegal lotto for years, at least since 2009, with prosecutors asking for sentences ranging from fifteen months in prison down to a €4,500 fine. Dutch Lottery History

The Staatsloterij turns 300 this year, and Nederlandse Loterij has been enjoying the anniversary. It started in 1726 with a draw in the Ridderzaal in The Hague involving 120,000 tickets, and it calls itself the oldest lottery in the Netherlands and the oldest still-running lottery in the world. What strikes me most is why it started. The first draws of the Generaliteitsloterij brought in extra state revenue, but they were also the legal answer to the many illegal lottery sellers of the time. Three centuries later, the same argument is present. The modern era moves fast. The football pools (TOTO) arrived in the late 1950s, the Lotto draw in the 1970s, and the Postcode Loterij in 1989. The Staatsloterij became a foundation in 1992, and from 2007 you could buy a Staatslot online. In 2016 the organisations behind the Staatsloterij and De Lotto combined, and the Ksa updated the names on their licences on 1 April of that year, which is how we got Nederlandse Loterij as one company.

The Dutch Lotteries Worth Knowing

The Staatsloterij is a classic "passive" lottery. You don't pick numbers; you buy a ticket with a number already on it, and there's a monthly draw (traditionally on the 10th). On top of that come the special draws. Nederlandse Loterij names the King's Day draw, the Droomsalaris draw, and the New Year's Eve draw as its iconic ones, and claims the Staatsloterij has the biggest tax-free prize pool each year. For the anniversary, there's a free jubilee draw open to all Dutch residents with a €1 million top prize. A free lottery ticket from the state. I'll take it.

The New Year's Eve Draw

The Oudejaarstrekking is the closest thing the Netherlands has to a national lottery holiday. Tickets are sold for weeks, people give them as presents, and the draw lands on 31 December when half the country is frying oliebollen. The best story from recent years came via NL Times. After the 2023 draw, the winner of the €30 million prize didn't come forward for days. The ticket was sold in Woensdrecht in Brabant, and a lottery spokesperson suggested the winner might be on holiday or the ticket might still be sitting in a Christmas gift box. Over 7.2 million New Year's Eve tickets had been sold that year, a record at the time. The winner did eventually show up, about two weeks later.

Lotto: The Jackpot That Has To Fall

The Dutch Lotto is the one where you actually pick numbers: six from 1 to 45, plus a bonus ball (reservegetal). The Lotto site explains the 2025 relaunch, and it's cleverly designed. Every draw now starts with a jackpot machine containing 12 balls, 11 black and 1 yellow. A yellow ball means the jackpot is guaranteed to fall, going to the player or players with the most correct numbers even if nobody hits all six. A black ball means it only falls if someone gets all six.

Eurojackpot

Since there's no EuroMillions here, Eurojackpot is how the Dutch play for European-sized money. The Netherlands was one of the founding countries when it launched in 2012. You pick five numbers from 50 and two "Euro numbers" from 12; draws run twice a week (Tuesday and Friday), and the jackpot is capped at €120 million. It's sold through the same Nederlandse Loterij account you use for Lotto, which keeps things simple. The odds are long, of course. Hitting 5+2 is roughly 1 in 140 million, which puts it in the same territory as EuroMillions. So if someone tells you EuroMillions is the "better" lottery, they mostly mean the marketing is louder.

Lucky Day And Krasloten

Lucky Day is the daily numbers game in the Nederlandse Loterij family, a keno-style draw where you choose how many numbers to play. It's cheap, fast, and honestly the one I'd watch most closely if you're worried about your habits, simply because it's daily. Krasloten are the scratch cards you see by the till at Primera or Bruna. And here's a thing that surprises a lot of people: you can't scratch them online. Nederlandse Loterij asked the Ksa to amend its instant lottery licence so it could sell online scratch cards that are also scratched online, and the Ksa refused, saying the Wok gives no basis for it. The Council of State confirmed this in February 2025. In the September 2026 ruling, the Council also rejected the argument that buying scratch cards online and having them delivered makes them the same as online gambling, noting the long gap between purchase and play, and that a player still has to go to a shop to collect a prize.

The Charity Trio

Small correction to a lot of older guides, including the previous version of this page: the "trio" is a duo now. The BankGiro Loterij was folded into the VriendenLoterij a few years back, and today the VriendenLoterij carries the culture-focused mission the BankGiro used to have. If you had a BankGiro subscription, it quietly became a VriendenLoterij one. These lotteries work differently from Nederlandse Loterij's. You don't buy a ticket for one draw; you subscribe, pay monthly by direct debit, and your "ticket" is usually your postcode or a lot number that keeps playing. The Postcode Loterij's genius, and I say this half-admiringly and half-uncomfortably, is that it draws postcodes. When a postcode wins the Straatprijs, every participating household on that street wins. The ones who didn't play get to watch the TV crew arrive and hand out cheques next door. Psychologists noticed. Marcel Zeelenberg and Rik Pieters studied it in Organizational Behavior and Human Decision Processes (2004) and found that anticipated regret, specifically the fear of your neighbours winning without you, is a real driver of why people keep playing.

Dutch Quirks You Won't Find Elsewhere

Your postcode can be your ticket. You can win half a car. The state lottery is older than the Dutch state in its current form. Scratch cards are legal, but you can't scratch them online. The biggest lottery prizes are advertised online, which almost nobody else in Europe does. And the court system just spent four and a half years deciding whether a second company may sell scratch cards, and the answer was no.
