The ADM Decree from 17 September 2007 has legalized games of skill. That is, games that, even if “allowing for teh elements of chance”, are still dependent on skill. That decree, however, was limited to tournament poker. But with the ADM Decree from 10 January 2011, online poker games with cash became permitted as well.
As it happens with all the other forms of online gambling, poker is regulated by the Agenzia delle Dogane e Monopoli (ADM). The tax regime applied is based on profit and, in the case of poker - a game of skill - the tax rate is 20% of the gross gaming revenue.
